ABSTRACT.
Under the background of the new era, the theory of criminal procedure in China has gradually improved and developed, which not only adapts to the development direction of socialism with Chinese characteristics, but also conforms to the international development trend. In the practice of criminal justice, we must consider both the preventive effect of criminal law and the cost and benefit. It is very important to use mathematical methods to demonstrate the ratio of cost-benefit and find an optimal model. Whether it is when formulating criminal policies and regulations, or when balancing the rights of the defendant and the power of the state, we need to use this optimization model to help us make the best decisions and choices. This paper aims to use the optimized model to analyze the formulation of criminal policy and its specific application, so as to give full play to the function of criminal procedure.
